The Brand Protection and Enforcement team monitors physical and online outlets to ensure worldwide sales consist of genuine products authorized for sale in the relevant region. The team works closely with local law enforcement and customs officials to remove counterfeit or unauthorized products from retail and supply channels. The Brand Protection and Enforcement team is also responsible for managing enforcement against warranty and retail fraud schemes. This position also will support and coordinate with the Trademark Prosecution team. This full-time position is based at Western Digital’s corporate headquarters in San Jose, California.

 

 

ESSENTIAL DUTIES AND RESPONSIBILITIES:

  • Shaping and implementing brand protection and enforcement strategy in specific jurisdictions within the construct of the global company strategy

  • Counseling management and members of client business groups on matters involving trademarks and brand enforcement

  • Advising clients on available enforcement options and local strategy and its implementation

  • Managing and/or cooperating with appropriate internal and external partners, including internal teams, outside counsel, investigators, and state and federal law enforcement agencies

  • Managing pre-litigation enforcement activity including cease and desist letters, notice and takedown requests, commercial correspondence, and negotiating settlements

  • Attending or participating in pre-litigation activities, such as raids, and litigation activities, such as hearings, depositions, or trials, as needed

  • Identifying and managing appropriate litigation types and targets depending on jurisdiction, budget, and desired outcome, including prosecuting targets in criminal, civil and administrative forums

  • Drafting documents, interviewing internal witnesses and experts, compiling and presenting data, and authenticating products as part of pre-litigation and litigation enforcement activities

  • Working with internal teams to identify new targets and scams in various jurisdictions throughout the world

  • Coordinating online and public records investigations of case targets and effectively synthesizing and communicating findings to prioritize targets for enforcement actions

  • Conducting factual investigation and research including orchestrating test buys, identifying illicit behavior, identifying counterfeit products, and performing or coordinating further product testing and analysis

  • Collecting and preserving evidence of wrongdoing to maintain availability of all enforcement options

  • Maintaining and ensuring ethical standards and professional conduct of internal and external investigations

  • Identifying and prioritizing jurisdictions for new enforcement options and implementing them

  • Using internal and external digital tools to effectively manage cases, report results, and measure return on brand protection and enforcement activity

 

 

KNOWLEDGE, SKILLS, & QUALIFICATIONS:

  • Experience handling litigation matters, including attention to evidence preparation and preservation, case deadlines, budget management, and client counseling

  • Experience handling external investigations in the context of litigation  

  • Strong attention to accuracy, quality, details, and strong analytical skills

  • Interest and curiosity in following case leads and exploring intricacies of various case targets and schemes

  • Strong organizational and time management skills

  • Ability to multi-task on multiple projects and communicate effectively with personnel at all levels

  • Familiarity with state and federal criminal and civil legal systems; knowledge of foreign jurisdictions a plus

  • Familiarity with federal and state law enforcement agency structure and operation; knowledge of foreign jurisdictions a plus

 

ADDITIONAL QUALIFICATIONS:

  • Juris Doctorate (JD) from accredited law school

  • Current member of a state bar in good standing

  • 8-10 years of relevant experience in a law firm and/or in-house legal department

  • Experience working in or with technology companies or in the technology industry
